Not that there isn’t a free speech issue here

It’s not that I don’t think that free speech shouldn’t be near-absolute or that there isn’t a free speech claim here, but that free speech (all civil liberties, really) come down to the same thing all other political issues come down to: power. Even if we protect civil liberties in some/most cases, the fact that we don’t protect them in all similarly situated cases, and that we make such a distinction based on the relative cultural power of the actors, should be pointed out.
